What are the collateral consequences of a domestic abuse conviction?

There are several statutes governing domestic abuse. Each of these statutes is designed to protect specific classes of victims. These victims include dating partners, spouses, former spouses, and former live-in dating partners. Prosecutors treat domestic abuse cases very seriously, and the consequences of being convicted of a domestic abuse charge are severe. The following are just some of the collateral consequences of a domestic abuse conviction:

  • Domestic abuse offenses are enhanceable. When an offense is enhanceable, each subsequent conviction will result in harsher punishments and higher fines.
  • A person convicted of a domestic abuse charge may not own or possess a firearm.
  • If the convicted offender has minor children, a domestic abuse conviction may affect custody and/or visitation rights.
