How may a finding of adultery affect my Louisiana divorce proceeding?

If after a contradictory hearing, the court determines that one of the spouses committed adultery during the marriage, an immediate divorce will be granted under art. 103(2) of the Civil Code. This means that the parties do not have to live separate and apart for a requisite time period before the divorce is granted. Also, the spouse who was found to be at fault will not be able to collect final periodic support (alimony). The adulterous spouse may still be able to collect interim spousal support, however, since fault is not taken into consideration when the court grants an award for interim support.
